What Is a Personal Injury Lawsuit?

A personal injury claim arises when someone is injured due to another party’s negligent, reckless, or intentional conduct. Although many injury claims can and should be settled through negotiations with an insurance company, insurers often deny valid claims or attempt to pay as little as possible. If an insurer fails to make a fair and reasonable offer, our tenacious team will provide aggressive courtroom representation.

Why Choose Us?

At Michael Kawi Law, we provide our clients with the highest standards of professional excellence. Founding attorney Michael Kawi has a well-earned reputation as a dedicated advocate and skilled trial attorney.

Before helping injured people get justice, the firm’s founder, Michael Kawi, spent over a decade in public service, helping those who could not afford an attorney. At this firm, we bring the values of public service into private practice. Not only will you pay nothing unless we win, but our fees after we win are lower than those of many injury firms, allowing you to keep more of your judgment.

Trust Michael Kawi Law to guide you through the process and protect your rights at every step.

The Michael Kaw Law Difference: 100% free unless we win – lower fees when we do

Like most injury firms, we charge no fee unless we win, but we take protecting our clients’ futures a step further. We charge a lower percentage of your settlement or judgment, allowing you to keep thousands or even tens of thousands of dollars more.

Keeping more of your money will help you and your family recover faster from the harm you’ve suffered and give you more peace of mind for the future. It’s just the fair thing to do.

Our Firm Handles All Types of Injury Claims

At Michael Kawi Law, we leverage our negotiating skills and trial experience to handle a wide range of injury claims, including:

  • Car accidents can cause severe injuries and damage. After an accident, it’s essential to get medical help, report the incident to the police, and gather evidence. Trust our firm to protect our rights and help you obtain compensation for medical bills, lost wages, and other damages.
  • Truck collisions are often severe due to the size and weight of trucks. Victims may face complex legal issues involving trucking companies and regulations. It’s crucial to gather evidence, seek medical treatment, and consult with our experienced truck accident attorney to get the compensation you deserve.
  • Motorcycle accidents can lead to severe injuries because riders have little protection. If you’re in a motorcycle accident, get medical attention immediately, report the incident, and document the scene. Our team can help you navigate your claim and seek compensation for your injuries and damages.
  • Bicycle accidents can result in significant injuries. Cyclists should follow traffic laws and ride safely, but if an accident occurs, it’s essential to seek medical help, report the incident, and document what happened. Our firm can assist in pursuing compensation for medical costs and other losses.
  • Construction accidents can result from falls, equipment failures, or unsafe conditions. Workers should report accidents to their supervisors, seek medical care, and document hazards. Workers’ compensation may cover some costs, but our team can help explore additional claims for total compensation.
  • Slip and fall accidents can result in broken bones or head injuries. If you slip and fall, report it to the property owner, seek medical treatment, and document the dangerous condition. Our team can help determine liability and pursue compensation for your injuries and related costs.
  • Dog bites can lead to painful injuries and infections. If bitten, seek medical care, report the incident to local authorities, and gather information about the dog and its owner. We can help you pursue compensation for medical expenses, pain, and emotional distress caused by the bite.
  • Medical negligence arising from surgical mistakes, misdiagnoses, and medication errors is not uncommon. Our firm has the resources to handle claims and the determination to secure the compensation you need to recover and move forward.
  • Traumatic brain injuries can be life-altering, impacting your cognitive abilities, memory, and quality of life. At Michael Kawi Law, we understand the long-term challenges of TBI cases and will pursue the maximum compensation for your medical care, rehabilitation, and other damages.
  • Catastrophic injuries, such as spinal cord injuries and severe burns, often require extensive medical treatment and long-term care. Michael Kawi Law is committed to helping you obtain compensation for your medical expenses, lost income, and future needs so you can rebuild your life.
  • Rideshare accidents can leave victims with serious injuries and complicated insurance claims. Michael Kawi has the skill to handle Uber and Lyft accidents, ensuring you receive compensation for your injuries, medical bills, and lost wages, whether from the rideshare company or other parties involved.
  • Worker’s compensation benefits are available to injured workers, but obtaining these vital benefits can be challenging. Trust Michael Kawi Law to guide you through the complex claims process and help you secure the benefits you deserve.

No matter the size of your case, we will provide the skilled representation you need and the personalized attention you deserve. Let us handle all the legal details so you can focus on healing.

How Much Is My Personal Injury Claim Worth?

No two cases are the same, and the compensation you receive depends on factors such as the nature of the incident, the severity of your injuries, and the degree of your liability. Nonetheless, you may be entitled to compensation that includes economic and noneconomic damages:

  • Economic damages cover lost income, medical expenses (present and future), property damage, and other financial losses.
  • Noneconomic damages compensate you for intangible losses, such as pain and suffering, permanent disability, disfigurement, emotional distress, and loss of enjoyment of life.

Punitive damages may also be available if the defendant’s conduct was egregious or illegal (e.g., drunk driving, assault). These damages are intended to punish the defendant’s misconduct and deter others from similar wrongdoing.

What Is Comparative Negligence?

Illinois follows a modified comparative negligence rule for personal injury claims. This means you can recover damages if you are 50 percent or less at fault for an accident. However, if you are found to be 51 percent or more at fault, you are barred from recovering any compensation.

Example of Negligence

For example, if you are in a car accident and awarded $10,000 in damages but found 30% responsible, you would only receive $7,000. However, you won’t receive compensation if you’re 51% or more at fault.

This is why hiring an attorney who will look at your case’s facts and tailor their strategy to prove that you are not at fault for your injuries is so important.

You can depend on our team to limit any liability assigned to you, hold the responsible party accountable, and protect your rights.
